In these Terms and Conditions “we” and “us” mean RED PUP PTY. LTD. ACN 164 175 482 trading as 'POCHA LEATHER', the Website Owner, and “you” means you the customer, buyer or site visitor.

Please read the Terms and Conditions carefully before placing any orders on www.pochaleather.com.au

These Terms and Conditions together with your order constitute the entire contract between POCHA and you for the supply of products. No other Terms and Conditions will apply. The contract may not be altered unless agreed to by both parties in writing or via email.

From time to time we may change the Terms and Conditions on www.pochaleather.com.au. Please make sure you have read our Terms and Conditions at the time of purchase.

Sale Conditions

The products available may vary from those shown on our website. If a product page is displaying the message “Sold Out” in red, please contact us for alternate stock availability of the item you are interested in.

At POCHA we strive on providing excellent customer experience to all our customers, and we are determined to ensure you are happy and satisfied with your order. Prices

We always seek to list products at competitive prices. POCHA reserves the right to change prices for products displayed on our online site at any time. The price payable for the Goods shall be THE price applicable on the date the Goods are confirmed as ordered. Advertised prices are in Australian Dollars and are all inclusive of Goods and Service Tax (GST). Sometimes typographical or human errors may occur, in which case we will try our best to quickly rectify, but we hold no responsibility for.

Goods & Service Tax (GST)

On all Australian orders the online prices on www.pochaleather.com.au are inclusive of the 10% GST charge on purchases. On International Orders, no Australian GST is charged.

Currency

All prices shown are in Australian Dollars.

Colours

The colours of products will sometimes vary depending on the quality and make of the computer monitors they are being viewed on.

Warranty

POCHA warrantees all products with a 24 month limited warranty on parts and workmanship. Normal wear and tear and damage that is caused through misuse/abuse and airline handling DO NOT qualify for coverage under our warranty.

In the rare case that a product should fail please email info@pochaleather.com.au with the claim and proof of purchase (order number, purchaser details and date of purchase). A return authorization and shipping instructions will be emailed to you within 24 hours (by end of day Monday if claim is submitted over the weekend). The item will be replaced at no additional charge subject to availability.

If a claim should arise during between the 2nd and 12th month of the purchase, POCHA will repair the product. Please email info@pochaleather.com.au with the claim and proof of purchase (order number, purchaser details and date of purchase). A return authorization and shipping instructions will be emailed to you within 24 hours (by end of day Monday if claim is submitted over the weekend).

IMPORTANT: The irregularities and variations of colour, shading and texture, and the imperfections (wrinkles, veins, and scratches) are natural characteristics of leather and are authentic features of the grain. These irregularities add to its natural and unique beauty and in no way are to be considered defects or damages. No two items will be exactly the same – this is your best guarantee of its authenticity.

Order Acceptance

Once order placement has occurred, you are engaged in a contract that sees you unconditionally accept the prices and descriptions of the items you have ordered. Once an order has been placed on www.pochaleather.com.au, you will receive an email confirmation of payment. This email does not promote acceptance of the order, it is simply a confirmation that we have received it.

Unless an order is cancelled by you - the buyer -, order acceptance does not occur until POCHA has emailed you informing you that your order has been dispatched. Once this has occurred, the sale contract has concluded.

If we are unable to obtain authorisation for payment or in the case where we may suspect fraudulent use of credit card – we reserve the right not to accept your order. We also reserve the right to not accept your order if certain shipping restrictions apply for the area of delivery, or if the item ordered is out of stock or withdrawn from sale for any particular reason.

This Website uses cookies to allow the web server to recognise you as a unique user when you visit. These cookies are necessary for the proper functioning of certain data access features on the site, such as the online shopping component. Cookies allow programs running on the web server to keep track of your order data.

POCHA reserves the right to limit the quantities of product sold to you. It is a condition of this Agreement that you do not resell the Products to a third party.

This Agreement must be read in conjunction with the Shipping and Returns Policy and our Privacy Statement. These documents form part of this Agreement.

Payment Information

Payment can be made using Visa, MasterCard and Paypal. Payment will be processed as soon as your order has been submitted. In the event that your order cannot be filled – a refund for the full purchase amount will be processed immediately.

By placing an order online you are confirming that the credit card you are using belongs to you. All credit card holders are subject to validation and authorisation checks by the card issuer. This is especially relevant for overseas orders.

All credit card transactions on www.pochaleather.com.au are processed using Paypal HSS, a secure online payment gateway that encrypts data obtained from customers to ensure it is kept private and secure.

Shipping Information

POCHA will cover the shipping cost of any goods purchased through www.pochaleather.com.au to your postal address if;

  • The postal address is an Australian address, and
  • The goods posted are not exchanged or repaired goods.

    POCHA reserves the right to charge shipping cost if the parcel has been returned to Sender due to the uncompleted or unattended shipping address.

    When estimating the delivery time of your goods please consider the following;

  • Order processing will not commence until credit card authorisation and address verification has occurred.
  • Orders which are placed after 3:00pm (EST) may not be processed until the next day. Therefore unless you place your order before 3:00pm (EST), it may not be actioned until the following day.
  • Please allow at least 1-2 days handling time before your order is dispatched. Where possible we will try to process orders for shipment on the same day of purchase, but this will vary depending on the quantity of orders at any given time.
  • Orders which are placed over the Weekend or on a Public Holiday will not be processed until the next business day, at the earliest. Business days are Monday to Friday, excluding QLD Public Holidays.
  • Please note when completing your order form to include a valid Street Number and Name, Suburb, Post Code and Phone Number. Orders cannot be processed without this information, and we will not be held responsible for any delays or charges incurred because of this missing data.
  • Please be sure to provide an address THAT will be attended when delivery occurs. POCHA uses a courier/postage service to deliver our products – but in the event of the shipping address being unattended, POCHA reserves the right to leave the parcel at the delivery address without requiring signature. In the best interest and safety of your order – please consider sending your parcel to a location that is occupied between the working hours of 9am-5pm Monday to Friday.
  • If your order does not arrive more than 7 days after dispatch confirmation email is sent, please contact us at info@pochaleather.com.au.
  • If you are purchasing from POCHA Website from any country other than Australia, longer delivery estimation applies. For orders to New Zealand, please allow at least 2 week from confirmation dispatch email for your order to arrive. For orders being delivered to anywhere other than Australia or New Zealand please allow 4 weeks in order to receive your parcel.

    Returns & Exchanges

    At POCHA we will happily exchange or refund you for unsuitable items where intent to return item has been emailed to info@pochaleather.com.au.

    GOODS MUST BE RETURNED UNWORN AND UNUSED WITH THE ORIGINAL TAGS AND PACKAGING..

    Items exchanged will be exchanged at the retail prices/values that were effective on the date of the original transaction. Full refunds are only available on Full Price items. Where a sale item has been purchased, customers are welcome to exchange but not refund the item. Exchange of sale goods – must only be in exchange for other sale items. Any refunds processed will not include refund of the postage fee (if applicable) - only the amount of the item purchased.

    Return of goods via mail

    Before returning goods please send us an email to info@pochaleather.com.au describing the problem or reason for return. We will then email you shipping instructions, return address and return number. When approved, the item/s must then be forwarded to POCHA by registered mail. For countries other than Australia please indicate ‘return of non conforming merchandise’ on customs forms. Upon receiving the item/s, allow 5-10 business days from the day you return your goods to process the return, whether it be exchanged of goods delivered to you, a refund, or a credit note issued. Refunds will be made within 1 week of the return of the product.

    Gift Voucher

    Gift Vouchers are valid for 6 months from date of purchase.

    Gift Vouchers can be redeemed against any product on the www.pochaleather.com.au (subject to availability).

    Gift Vouchers are non transferable and cannot be returned or redeemed for cash.

    If you wish to return products you have purchased using a Gift Voucher, you are not entitled to a refund - however you are welcome to exchange for another product. Please see Returns & Exchanges.

    POCHA's Gift Vouchers can be used on sale items.

    POCHA is not responsible if a Gift Voucher is lost, stolen, destroyed or used without permission.

    POCHA reserves the right to cancel a Gift Voucher if we deem such action necessary.

    Promotional codes cannot be applied to the purchase of Gift Vouchers.

    Shipping is free for any POCHA Gift Voucher provided it is not purchased with any other product, and it is being shipped within Australia.

POCHA does not accept responsibility for any errors, or omissions in the site contents. Although, POCHA will be pleased to correct any errors displayed on our web pages. POCHA reserves the right to change or discontinue any aspect or feature of this website. POCHA intends to use royalty-free material for the site and not to use any copyrighted material. If this occurs, we’ll remove it.

    POCHA does not accept any liability for any loss or damage suffered (directly or indirectly) by making use of the site’s information. Nor can we guarantee that pages will display correctly in all web browsers or that the website will be online at all times. We cannot accept responsibility for events publicised on our site and we advise anyone planning to attend at an event listed to recheck details. POCHA cannot accept any responsibility for any loss, disruption or damage to your data or your computer system which may happen when accessing this website. With any Links posted, the onus is on the visitor and POCHA is not responsible in any way for any of their contents.

    Legal capacity to transact

    If you are under the age eighteen (18) years you CANNOT place orders with POCHA. By accepting these Terms and Conditions you acknowledge that you are over the age of eighteen (18) years. Should POCHA suffer any damage or other losses as a result of a transaction entered into by a minor, POCHA reserves the right to seek compensation for such losses from the parents or guardians of the minor who caused any order(s) to be placed on POCHA's Website.

    Our liability

    We will not be liable for any loss of income, loss of profits, loss of contracts, loss of data or for any indirect or consequential loss or damage of any kind howsoever arising and whether caused by tort (including negligence), breach of contract or otherwise. Our maximum aggregate liability for any products supplied to you whether in contract, tort (including negligence) or otherwise shall in no circumstances exceed the amount payable by you to us in respect of the products(s) in question.

    Credit card fraud

    POCHA will not be responsible for any damages, consequential losses (whether direct or indirect) suffered by a customer whose credit card is fraudulently used or is used in an un-authorised manner.

    Force majeure

    POCHA shall not be liable for any delay in performing any of its obligations under these Terms and Conditions if such delay is caused by circumstances beyond the reasonable control of POCHA, and POCHA shall be entitled to a reasonable extension of time for the performance of such obligations.

    Governing law

    These Terms and Conditions shall be governed by and construed in accordance with the laws of Victoria, Australia and shall be subject to the non-exclusive jurisdiction of the courts of Victoria, Australia.

    Other terms

    Our website is provided in the state of Queensland, Australia and conditions of use are subject to Australian law which governs this User Agreement. We do not guarantee continuous, uninterrupted or secure access to our website and operation of our website may be interfered with or adversely affected by numerous factors or circumstances beyond of our control.
